1. Contractual Parties & Scope

This website is operated by TERRAFRIQ (PTY) LTD (Registration Number: 2024/147464/07), a private company registered in the Republic of South Africa. Terrafriq provides an online marketplace directory connecting independent clients with professional architectural designers and consultants, along with a merchandise storefront.

2. Matchmaking & Escrow Services

Terrafriq facilitates project matchmaking through the platform's Workroom portal. When a client and an architect establish a contract, they define specific Project Milestones. Funds are held in a secure, milestone-based Escrow system managed via third-party processors (such as Stripe Connect). Terrafriq acts strictly as a neutral facilitator and is not a party to any contract, transaction, or agreement entered into between clients and architects.

3. Limitation of Liability

Terrafriq does not guarantee, audit, or assume liability for the structural integrity, safety, regulatory compliance, engineering precision, or implementation feasibility of any blueprints, CAD files, structural specifications, or designs downloaded or contracted through this platform.

CRITICAL NOTICE: It is the sole responsibility of the client to hire licensed local structural engineers and qualified surveyors to review and certify all architectural documents against local building regulations and soil properties prior to construction.

4. Escrow Disputes & Fees

Escrow funds will be released to the architect only upon approval of the deliverable milestone by the client. In the event of a dispute regarding milestone deliverables, Terrafriq reserves the right to review Workroom communication logs to arbitrate payouts. Platform commission cuts and lead unlocking fees are non-refundable.

5. Intellectual Property

All assets, blueprints, content files, site copy, graphics, and custom apparel designs displayed on this website are protected by national and international copyright laws. Any unauthorized distribution, reproduction, or commercial exploitation is strictly prohibited.

6. Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the South African courts.
